1.    General terms and conditions of use

Individuals accessing information made available by Geneva public transport (hereinafter "tpg") through the website www.evomoov.ch (hereinafter the evomoov website or the website) accept the following conditions:

The entire content of the evomoov website (text, images, logos, videos, etc.) is covered by copyright © evomoov and other intellectual property rights. tpg hold all the rights. Reproduction of the resources, in whole or in part, in any written or electronic form, is authorized only with express mention of evomoov and/or tpg. The website may not be reproduced, transmitted, modified, linked or used for public or commercial purposes without the prior written consent of tpg.

3.     Property rights and trademark rights

The names and logos of tpg, evomoov, tpg evomoov and tpg business partners are registered and protected trademarks. Nothing contained on the website is intended to constitute a license or right to use any image, registered trademark or logo. tpg reserves all rights relating to the elements of its website, with the exception of rights held by third parties.

4.     Exclusion of liability

tpg accepts no liability whatsoever for any loss or damage of any kind incurred by themselves or third parties as a result of access to or use of its website or parts thereof, or caused by links to third-party websites. Visiting the evomoov.ch website and using the information and offers contained therein excludes any liability on the part of tpg. Any liability on the part of tpg is also excluded in the event of loss of earnings, Internet errors of any kind (e.g. service interruptions, malfunctions, viruses, harmful components, terrorist acts, etc.), misuse by third parties (data retrieval, copying, etc.) or loss of programs or other data in your information systems. These exclusions apply even if the website draws attention to the risk of such damage. 
The information published on the website, particularly that relating to prices, is for information purposes only. tpg does not guarantee the accuracy or completeness of the information contained on the website. It reserves the right to modify them at any time and without notice. Accordingly, tpg assumes no liability for any direct, indirect or consequential damages that may result from access to, use of or inability to access the resources and information on this website.

Certain links on the evomoov website provide access to other sites, over which tpg has no control. tpg therefore assumes no responsibility for the completeness, comprehensiveness and legality of the contents of the linked sites, nor for any products, offers or (services) provided. The same applies when these sites contain the tpg logo or name or another protected designation. The use of linked websites is the responsibility of the individual user.

6.     Use of cookies

tpg may use cookies on its website to offer users a personalized welcome that takes account of their visiting habits and to keep track of their personal data. Cookies can also be used by tpg to provide preventive security and user data protection (in particular, by means of information relating to the server to which your computer is connected). tpg stores certain information about the site user's computer (browser used, computer operating system, etc.) as well as the IP address of its visitors (the IP address consists of a series of numbers automatically assigned to your computer by your ISP or by your company's Internet server at the start of each Internet session). tpg’s aim in collecting this data is to be able to gather information on the use and performance of the website. tpg ensures compliance with the legal provisions on data protection. (See “tpg data protection statement”).
The evomoov website, accessible directly from tpg.ch, has been designed to smooth exchanges with Geneva public transport (tpg). It allows users to fill in online forms to get in touch with our sales teams, share documents such as data sheets or white papers, or request quotes and orders.

       A)     Purpose and legal basis of data processing

As part of its B2B and B2G activities, tpg processes the data collected via these online forms in order to respond efficiently to user requests. This includes the sending of informative documents, requests for information (via the "contact us" section), opt-in, newsletter subscriptions, replies to requests for quotations and order management. This approach is part of the Marketing, Sales and Communication (hereafter MSC) department's mission to support companies, institutions and local authorities in the co-construction of sustainable mobility. Your consent provides the legal basis for the processing. No automatic decisions are made on the basis of the data collected, and no profiling is carried out.

The data collected via forms is necessary to identify and contact users. They are grouped into the following categories:

The recipients of your data are tpg sales teams, the only ones authorized to process your data for the purposes to which you have consented.

       D)     Data retention and destruction

Your data will be kept for up to three years following receipt of your consent. You may withdraw your consent at any time, which will result in the deletion of your data.

       E)     Your rights

  • Right to be informed: this notice informs you about how your personal data is collected and used when you fill in a contact form via this microsite.
  • Right of access: you have the right to access your personal data that we have collected as part of your request via the form. We will provide you with a copy of the information we hold.
  • Right to data accuracy: if you discover that your data is inaccurate or incomplete, you have the right to request that it be corrected or updated. You can do this directly via our contact form or by sending us a request to the address below.
  • Right to erasure: you may request the erasure of your personal data if it is no longer required for the purposes for which it was collected, or if you withdraw your consent.
  • Right to withdraw consent: you may withdraw consent at any time, without affecting the lawfulness of the processing carried out prior to such withdrawal. If you withdraw your consent, your data will be deleted from our databases.

Only the French version of these general terms and conditions is binding.
tpg is free to modify these general terms and conditions of use at any time.

9.     Place of jurisdiction and applicable law

Any dispute arising from these conditions shall be resolved exclusively in the Canton of Geneva and in accordance with Swiss law.
